Obtain evidence of the other party's responsibility for the accident

We will need to obtain evidence to prove the other party involved in your car accident is responsible (i.e., liable) for causing the accident.  We will need to identify and take statements from any witnesses to the accident.  It is vital that this be done as soon as possible after the accident, while the witnesses can still be located and their memory is fresh.  We will obtain any existing surveillance or security videos of the accident, any photographs of the accident or its immediate aftermath, any police or other reports prepared regarding the accident, and any other physical evidence which could help prove liability of the other party.

Obtain evidence of your injuries

We will examine the medical evidence in order to evaluate your injuries.  We will work with your doctors to make sure they provide the medical information we need to win your case, such as complete copies of their medical files, x-rays, reports, etc.  We will communicate with all of your health care providers to obtain any missing medical records.  We will also help you get proper medical treatment so that you can recover from your injuries.

Communicate with the other driver’s insurer

​

The insurance adjuster has the ability to approve any settlement offer, and so it is critical to have good communications and a good relationship with the adjuster.  We will work with the other driver's insurance carrier to make sure that we obtain the maximum recovery possible.  Further, we will make it clear to the insurer that we are aggressive in protecting our client's rights and are willing to go to trial, if we are not satisfied with their settlement offer.

Retain appropriate Expert Witnesses

We will retain the experts necessary to help you win your case, who may need to testify at any trial that may occur.  Those experts may be medical experts, such as your treating doctor, or other medical experts, and experts such as those in the area of accident reconstruction.

Calculate damages

​

We will calculate property damages, lost wages (both present and projected into the future), medical expenses (both past and projected to occur in the future), other economic loss, pain and suffering, and other damages.  We will also retain, if necessary, experts in the fields of forensic economics and vocational rehabilitation to assist in these calculations and to testify at trial, if necessary.

Negotiating with lien holders

If you received benefits from a health, disability or workers compensation insurer, that insurer will have a lien on your claim.  We will negotiate with those lien holders to reduce the amount of their claim as much as possible, so that you can keep more of your recovery.
